Introduction

The rights of transgender persons in India gained constitutional recognition through the landmark judgment in NALSA v. Union of India, in which the Supreme Court recognised transgender persons as the “third gender” and affirmed their fundamental rights. Following this, Parliament enacted the Transgender Persons (Protection of Rights) Act, 2019 to safeguard their rights and promote social inclusion. This legal framework reflects India’s evolving environmental jurisprudence and social justice principles, similar to how the precautionary principle and polluter pays principle have shaped environmental democracy in cases requiring environmental clearance and environmental impact assessment.

 

Legal Framework

The 2019 Act prohibits discrimination against transgender persons in education, employment, healthcare, housing, and access to public services. It provides a mechanism for obtaining a transgender identity certificate from the District Magistrate and guarantees welfare measures. Just as the Forest Conservation Act and EIA Notification establish procedural safeguards for a pollution free environment, this Act creates institutional mechanisms to prevent ex post facto violations of transgender rights, avoiding retrospective environmental clearances-like situations where rights are recognized only after violations occur.
