Why in the news?

  • The Supreme Court has questioned the Election Commission (EC) regarding the delay in uploading authenticated voting data on its website after each phase of polling.
  • This inquiry stems from a petition by the Association for Democratic Reforms, alleging significant delays in releasing voter turnout data and a sudden increase in figures, raising doubts about the authenticity of the data and the integrity of electronic voting machines (EVMs).
  • Rules 49S and 56C (2) of the Conduct of Election Rules, 1961 mandate the preparation of voting records in Form 17C (Part I) format by Presiding Officers.

 About 56C (2) of the Conduct of Election Rules, 1961 :

  • Votes counted using the “Result” button on the control unit.
  • Votes for each candidate displayed on the control unit.
  • Details recorded on Form 17C, signed by counting supervisors and candidates or agents.
  • Entries made on Form 20 result sheet.
  • Option for totaliser use in specified constituencies for voter safety.

About Returning Officer (RO):

  • Returning Officer (RO) supervises elections in a constituency or as directed.
  • Appointed by the Election Commission (EC) in consultation with state/UT governments.
  • Role defined in Part IV of Representation of People Act, 1951.
  • Can oversee multiple constituencies if nominated by the EC.
