Supreme Court and Law Commission’s Stand:
Supreme Court’s Deliberations:
- Over the years, the Supreme Court has deliberated on UCC but refrained from directing its implementation, citing parliamentary jurisdiction.
- Previous judgments and petitions have called for its enactment, emphasizing gender equality and non-discrimination.
Law Commission’s Recommendations:
- The Law Commission of India, in its consultation paper, deemed a uniform civil code neither necessary nor desirable.
- However, it suggested amending discriminatory practices within existing personal laws.
