UTTARAKHAND’S HISTORIC UNIFORM CIVIL CODE
Why in the News?
- Uttarakhand Assembly passes the Uniform Civil Code (UCC) making it the first legislature in independent India to enforce common rules, excluding Scheduled Tribes.

UCC Amendments: Highlights
For Muslims:
- Marriage Age: Set at 18 for women and 21 for men, in line with Hindu Marriage Act, 1955.
- Succession Rules: Testamentary succession allows unrestricted property bequeathal through wills. In intestate succession, property passes to Class-1 heirs, or Class-2 heirs if former absent.
For Hindus:
- Succession Changes: Removes ancestral and self-acquired property distinction, affecting Mitakshara law’s coparcenary rights. Both parents elevated to Class I heirs in intestate succession.
General Provisions:
- Marriage Regulations: Prohibits bigamy and polygamy, criminalizing certain Muslim marriage practices.
- Divorce and Remarriage: Allows remarriage after divorce without additional conditions, penalizing coercion for remarriage with imprisonment up to three years and Rs 1 lakh fine.
