SC Questions Delay in Northeastern States’ Delimitation Process

Why in the news?

The Supreme Court questioned the Union government’s delay in initiating delimitation in Nagaland, Arunachal Pradesh, and Manipur, despite a 2020 order to begin the process.

Background:

• The Supreme Court raised concerns over the delay in the delimitation process in Nagaland, Arunachal Pradesh, and Manipur.
• The Court questioned the Union government for its inaction, despite a 2020 Presidential order rescinding the deferment of delimitation, citing improved security conditions.
• The Court emphasised the statutory mandate for the Election Commission to start the process once the deferment was lifted under Section 8A of the Representation of the People Act, 1950.

Government’s Defence:

• The government defended the delay, stating the sensitive socio-political environment in the northeastern region.
• Additional Solicitor General (ASG) KM Nataraj highlighted challenges in Arunachal Pradesh and Nagaland, with opposition from local communities and tribal groups expressing agitation over the proposed delimitation.
• The government is awaiting ground reports and ongoing consultations to assess whether conditions are conducive for proceeding with the exercise.

Delimitation:

• Definition: Process of determining seats and boundaries for Lok Sabha and State Legislative Assemblies.
• Conducted by: Delimitation Commission established under Parliament’s Acts.
• History: Last exercise in 1976, based on the 1971 Census.
