Supreme Court Bars Stem Cell Therapy for Autism

Why in the News ?

The Supreme Court of India ruled that stem cell therapy cannot be offered as a clinical service for Autism Spectrum Disorder (ASD) due to lack of proven scientific evidence, questioning the Centre’s inaction against clinics promoting unverified “miraculous cures”.

Supreme Court’s Key Observations and Ruling:

  • The Court held that stem cell “therapies” for ASD can be administered only within approved clinical trials or research settings, not as routine medical treatment.
  • A Bench of Justices J.B. Pardiwala and R. Mahadevan emphasised that the absence of proven efficacy and safety violates the reasonable standard of medical care owed by doctors to patients.
  • The Court noted a serious lack of established scientific evidence regarding the therapeutic use of stem cells for ASD.
  • It ruled that parents or caregivers cannot demand stem cell therapy as a matter of right or entitlement.
  • The judgment criticised the Union government’s failure to act against clinics offering such therapies, leading families to incur huge financial costs based on false hope.

Informed Consent, Ethics, and Patient Autonomy

  • The Court clarified that valid informed consent requires adequate disclosure of treatment details, including purpose, benefits, risks, alternatives, and consequences.
  • Since doctors lack reliable scientific data on stem cell therapy for ASD, they cannot provide adequate information, rendering consent legally invalid.
  • The Bench observed that patient autonomy cannot be extended to justify undergoing a scientifically unvalidated and ethically impermissible procedure.
  • Consent cannot be used to legitimise treatments that fall outside the bounds of reasonable medical practice.
  • The Court stressed that ethical medical care must be grounded in evidence-based medicine, not experimental claims marketed as cures.

Regulatory Framework on Stem Cell Research:

●     Stem Cell Therapy in India is governed by the New Drugs and Clinical Trial Rules, 2019, which restrict unapproved clinical use.

●     Stem cell interventions for most conditions remain in the experimental stage, requiring regulatory approval and monitoring.

●     The Court directed the Centre to establish a dedicated regulatory authority for nationwide oversight of stem cell research.

●     Unregulated promotion of stem cell cures violates principles of medical ethics, patient safety, and public trust.

●     The ruling reinforces the importance of evidence-based healthcare, particularly for vulnerable groups like children with ASD.
