MAHARASHTRA’S LATEST MARATHA QUOTA LAW:

Why in the news?

Maharashtra Assembly passed a 10% reservation Bill for Marathas in education and government jobs, facing scrutiny for judicial compliance.

Key Features of the Bill:

  • Bill does not affect the existing OBC quota; non-Kunbi Marathas are eligible under the new law.
  • Based on a report by Justice (retired) Sunil B Shukre-led commission, citing “exceptional circumstances” to justify reservation beyond the 50% limit.
  • The Supreme Court struck down previous quota laws, citing lack of “exceptional circumstances” to breach the 50% reservation cap.
What is the 102nd Amendment Act of 2018 ?

●   The 102nd Amendment Act of 2018 added Articles 338B and 342A to the Constitution.

●   Article 338B pertains to the establishment of the National Commission for Backward Classes.

●   Article 342A empowers the President to specify socially and educationally backward communities in a State.

●   Parliament has authority to include communities in the Central List for reservation benefits.
