GI Tags: Safeguarding India’s Cultural Heritage GS Paper 2 – Governance / IPR

Question: Examine the role of GI tags in preserving India’s intangible cultural heritage. How effective are they in international disputes?

Answer:

Geographical Indications (GI) play a critical role in preserving intangible cultural heritage by granting legal recognition to goods associated with a particular geographical region and traditional knowledge. India, under the GI Act, 1999, has recognized over 400 such items, including Kolhapuri sandals, Kanjeevaram silk, Madhubani paintings, and Darjeeling tea.

GI tags help protect local artisans against imitation, provide branding advantages, and promote cultural tourism and exports of Indian traditional products. However, their effectiveness in international enforcement remains limited due to the absence of universal GI frameworks and weak reciprocal protections under the TRIPS agreement of the WTO.

The Kolhapuri sandal controversy illustrates this gap. While the product enjoys GI protection in India, Italian luxury brand Prada replicated the design, including the distinctive toe-loop design, without legal repercussions abroad, undermining both the artisans’ rights and the GI system. This incident highlights the challenges in preventing cultural misappropriation on a global scale.

India must engage in IPR diplomacy, advocating for multilateral GI recognition, especially in trade negotiations and regional partnerships. Domestically, the GI ecosystem should be strengthened through awareness, legal aid, and marketing support for artisan groups who are the registered proprietors of these geographical indications.

In essence, GI tags are vital tools for cultural preservation, but their global enforcement mechanisms must evolve to ensure true protection and benefit-sharing for India’s traditional communities. The ability to take infringement action against unauthorized use in international markets remains a key challenge that needs to be addressed.
