Why in the news?

  • The Centre amended surrogacy rules, permitting the use of donor eggs or sperm for surrogacy.
  • Previous restrictions from March 2023, which prohibited donor gametes, were overturned.
  • The amendment allows the use of donor gametes if certified by the District Medical Board for couples with medical conditions.

About Surrogacy (Regulation) Act, 2021

  • Allows surrogacy for widowed/divorced women (35-45 years) and legally married couples with medical needs.
  • Permits only altruistic surrogacy, barring commercial transactions.
  • Prohibits commercial surrogacy, punishable by up to 10 years’ imprisonment and fines up to Rs 10 lakhs.
  • Requires genetic relation between the surrogate and intended parents.
What is Surrogacy?

·   Definition: Surrogacy is when a woman carries and gives birth to a baby for another person or couple.

·   Parties Involved: The surrogate (or birth parent) agrees to carry the baby, while the intended (or commissioning) parent(s) receive custody after birth

 

Types of surrogacy:

·   Altruistic Surrogacy:

  • Surrogate receives only medical expenses.
  • No financial gain for surrogate.

 

·   Commercial Surrogacy:

  • Involves monetary compensation.
  • Participants gain financially.
  • Surrogate and intermediaries profit.
