RETIREMENT AGE EXTENSION FOR JUDGES: GOVERNMENT’S STANCE

Why in the News?

Parliamentary Panel’s Recommendation:

  • The Standing Committee on Law and Personnel proposed a performance-based tenure extension for judges beyond the retirement age.
  • It suggested a system for performance appraisal, considering health, judgement quality, and quantity.

Government’s Response:

  • Linking performance evaluation to retirement age extension may not be practical and could undermine Parliament’s authority.
  • Concerns raised include potential favouritism, susceptibility to pressures, and burden on judicial and executive resources.
Constitutional Context

·   Currently, Supreme Court judges retire at 65, while High Court judges retire at 62.

About Venkatachaliah Report

·   The Venkatachaliah Report(Report of the National Commission to review the working of the Constitution) , issued in 2002, suggested increasing the retirement age for High Court Judges to 65 years.

·   It also proposed raising the retirement age for Supreme Court Judges to 68 years.
