Recent legal changes

 

  • Article 4: Divorces can be initiated by either men or women. Women did not previously have the authority to initiate a divorce.
  • Article 5: Discusses civil unions. The legal drinking age should be 21 for both men and women. Being connected to one another was a need, but that is no longer true. Additionally, the requirement of obtaining the bride’s father’s consent has been eliminated. The court should record the marriage. There is no longer a demand for witnesses.

 

  • Articles 6, 7, and 8: Unilateral or joint divorce. The marriage may be dissolved at any time by one of the partners. The party seeking the divorce is not required to establish fault. Before, one of the parties had to choose who was to blame before filing for divorce.
  • Article 9 states that the wife must request alimony. In the event that the spouse refuses to pay, the court will exercise its discretion to dispense justice.
  • Article 10: The UAE is the first country to establish the idea of joint custody of children.
